Berger Kahn Recovers Over $1 Million in Agent Errors and Omissions Case ORANGE COUNTY, CA -- Craig S. Simon, the managing partner of Berger Kahn, successfully represented a top tier nationwide homeowners carrier in a dispute with an agent over the placement of a homeowners policy. The insurer contended that the agent knew or should have known that the home was undergoing a seven figure remodel, that the insureds never moved in to the house for over a year after escrow closed, and that the risk was ineligible under the written guidelines of the carrier. The agent contended that the customer did not inform him of the intention to do a major remodel, and also that the risk was eligible, since the actual renovations did not start until after escrow closed. The house burned down during the remodel. Under the terms of the settlement, the insurer will recover over $1 million. The case resolved with the assistance of mediator Hon. John Kennedy of JAMS while an arbitration procedure was pending. Back |
