Case Facts: This litigation arose out of a tragic automobile accident on an Orange County toll road involving a 39-year-old father who had just returned from a round of golf with his friends. The Decedent was fatally injured when the driver of his vehicle allegedly fell asleep at the wheel and rear ended a slower moving commercial vehicle. The Decedent's heirs (spouse, two minor children and mother) filed a wrongful death lawsuit against the driver and the commercial vehicle owner, driver, and manufacturer. The case settled at the second mediation 12 days before trial.
