Real Estate

The real estate industry, which has undergone a series of ups and downs over the last two decades, remains an industry in constant flux.

At Berger Kahn, we are well-equipped to deal with the business cycle fluctuations that still characterize real estate finance, development, management and leasing. Utilizing years of experience in this field, our attorneys understand the entire cycle — beginning with land acquisition and construction financing and progressing to the handling of stop notices and mechanics liens, workouts, commercial leases, receiverships and foreclosures (often with a stop in Bankruptcy Court along the way). The entire process, of course, can begin again with the financing of the property for a new owner.

Our expertise in real estate flows from three qualities we strive to maintain:

  • Vast experience. For over 20 years, we have represented secured creditors nationwide and helped them in negotiations and litigation involving commercial property. We are equally well-versed in the field of real property acquisition and development, including environmental impact issues, zoning, and other restrictions on land use. Our lease enforcement practice has been highly successful for landlords, usually obtaining full judgments with fees and costs, or equally cost-effective settlements.

  • Practical knowledge. Our understanding of the business of real estate enables us to approach problems from the business executive’s point of view and to achieve results that make sense from both a legal and economic perspective. We recognize that there may be more than one solution to the problem. Our goal is to find the right solution for a specific client by using the legal process as a means to that end, rather than an end in itself.

  • Technical skill. Without technical skill, experience and practical know-how amount to very little in the field of real estate law, where ancient doctrines and complex statutes combine to lay traps for the less-careful practitioner. Whether drafting agreements or leases, prosecuting unlawful detainer cases, installing receivers or litigating any of the myriad issues which so frequently arise, we represent our clients with exhaustive attention to detail.
