Mortgage Banking

The mortgage banking industry has evolved tremendously in recent years. Changing interest rates, increasing regulation and other industry trends have caused some mortgage bankers to withdraw from the market, have caused other players to revise their strategies and have resulted in increased consolidations, sales and acquisitions of mortgage bankers.

At Berger Kahn, we not only understand the significance of industry trends — we anticipate them. In existence for over 20 years, our mortgage banking group consists of some of the most seasoned business lawyers and litigators in the mortgage banking field. As a result, we are able to present legal options that might be overlooked by those who lack the insight and specialized expertise that result from our depth of experience within the mortgage banking arena.

We are well-versed in all areas of law affecting mortgage bankers, mortgage brokers, and other businesses involved in the mortgage lending industry and have handled most types of legal matters relating to the mortgage lending and related industries — including some of the most significant and complex transactions to occur in recent years. We routinely oversee all types of regulatory, compliance and licensing issues that require a close working relationship with state and federal regulators. Our attorneys have not only advised private companies, but have also advised quasi-governmental agencies.

While some members of our group have substantial experience serving as general counsel to some of the country’s leading mortgage bankers, others are expert in handling multibillion-dollar transactions and significant litigation, including major servicing sales and purchases, corporate restructurings, securities matters, warehouse agreements, assets sales and acquisitions, litigating precedent-setting cases and training client personnel to handle specific legal matters more efficiently.

Our goal is to make the best use of the mortgage banker’s resources. Working closely with key executives and in-house counsel, we discuss with each client its concerns and priorities. This results in highly effective legal plans, complete with both practical and technical advice dispensed in a timely manner which keeps pace with the evolving mortgage banking industry.

Our qualifications include the following:

  • Experience. While all of the attorneys in the mortgage banking group are expert in real estate lending law, many have served as senior officers of leading mortgage banks. Our experience enables us to recognize the inter-relationship between legal and business issues and to provide guidance from the perspective of both outside law firms and the mortgage banker’s legal department.

  • Skill. Dynamic and aggressive in the pursuit of clients’ rights, our litigators represent both plaintiffs and defendants in a wide variety of cases — including those involving fraud, employment issues, contractual disputes and disputes with other participants in the mortgage lending arena. We are known for our dynamic presentations in court and our ability to handle even the most controversial cases. Our business lawyers have significant experience representing some of the country’s major mortgage lenders in transactions of all types, including major servicing sales, acquisitions of mortgage companies and warehouse lending transactions.

  • Resourcefulness. In order to provide the highest possible value and service for our legal fees, we create approaches and solutions that ensure the most efficient and cost-effective use of the mortgage banker’s resources.

Our experience in the mortgage banking arena is reflected by the fact that we are often invited to speak at meetings sponsored by key members of the mortgage banking industry and to author books and articles on related issues.
