Time Off for Voting Requirements
Employment/Labor

October 17, 2006

California state law requires employers to post a notice to your employees advising them of provisions for taking paid time off for the purpose of voting in statewide elections.

California Elections Code Section 14001 permits employees to take no more than two hours paid time off for the purpose of voting if they do not have sufficient time outside of working hours to vote. The time off for voting shall be only at the beginning or end of the regular working shift, whichever allows for the most free time for voting and the least time off from the regular working shift, unless otherwise mutually agreed.

You may require employees to give two days advance notice that time off for voting is desired, in accordance with the provisions of this section.

Employers must post the "Time Off To Vote" notice 10 days before any statewide election.

For more information, including a "Time Off to Vote" poster that you can download, visit the California Secretary of State web site at: http:// www.ss.ca.gov/elections/elections_tov.htm.
